Reasonable Excuses

 

As the year end self assessment online tax deadline is almost upon us (that's tomorrow folks!), here are a list of reasonable excuses for tardiness as per HMRC:

Reasonable excuses

You can appeal against some penalties if you have a reasonable excuse, for example for your return or payment being late.

What may count as a reasonable excuse

A reasonable excuse is something that stopped you meeting a tax obligation that you took reasonable care to meet, for example:
  • your partner or another close relative died shortly before the tax return or payment deadline
  • you had an unexpected stay in hospital that prevented you from dealing with your tax affairs
  • you had a serious or life-threatening illness
  • your computer or software failed just before or while you were preparing your online return
  • service issues with HM Revenue and Customs (HMRC) online services
  • a fire, flood or theft prevented you from completing your tax return
  • postal delays that you couldn’t have predicted
  • delays related to a disability you have
You must send your return or payment as soon as possible after your reasonable excuse is resolved.

What won’t count as a reasonable excuse

The following won’t be accepted as a reasonable excuse:
  • you relied on someone else to send your return and they didn’t
  • your cheque bounced or payment failed because you didn’t have enough money
  • you found the HMRC online system too difficult to use
  • you didn’t get a reminder from HMRC
  • you made a mistake on your tax return

Automated HMRC Fines and The Gates of Hell


In December I noted that a Tribunal had invalidated an HMRC automated penalty, because it was not created by a "flesh and blood human being".

Almost two months later, and the mainstream media is now reporting the ruling. HMRC remains nonplussed, and is quoted by the Telegraph:
"This case was about whether the company had a reasonable excuse for filing late. 

This type of penalty is applied to encourage companies to comply with their obligations, to act as a sanction for those who don’t and to reassure the compliant majority that they will not be disadvantaged by those who don’t play by the rules.

Penalties issued by HMRC to those who file late are due and payable. Any taxpayer with a reasonable excuse for filing late should get in touch with us."
However, it should be noted that HMRC did not appeal the ruling, lest they lose and open up the gates of hell wrt negating other automated fines!

Self Assessment Glitches


The ICAEW has become aware of more errors in HMRC’s self assessment (SA) calculations and a number of other current SA issues.

All in all pretty disgraceful. Yet our "beloved" political elite don't give a monkey's, because they pay tax professionals to sort through this mess when submitting their returns!

Details as per the ICAEW:

These issues come on top of:
  • A longer list of self assessment exclusions to deal with calculation issues and the first ever in-year update to SA software.
  • The SA (and other) systems being unavailable between Thursday 4 and Saturday 6 January 2018. 
Error in calculation of capital gains tax affecting some trust returns

HMRC has advised us of an issue affecting a small number of electronically filed SA900 SA returns for trusts. HMRC’s systems are showing inaccurate calculations of capital gains tax in some cases. We have been advised that the problem has now been resolved and calculations shown in HMRC’s systems should now be correct for returns filed from 16 January 2018. HMRC will check and correct calculations for returns already filed.  

The 31 January payment should be based on the tax correctly calculated by commercial software.

Other errors being investigated

Members have reported some further calculation errors; these are still being investigated to check whether they are widespread.

One report concerns HMRC’s calculator not allowing the CGT annual exempt amount (and possibly any remaining basic rate band) to be wholly set against gains due at 18/28% rather than 10/20%.
Another concerns two cases where HMRC adjustments for marriage allowance reduced the liability in one case to zero and in another case to the previous value for payments on account.

HMRC pre-population service within third party software unavailable

Agents are currently unable to use the HMRC pre-population service (for employment data) within third party software. The service was disabled on 16 January 2018 while the problem is investigated.

SA statements missing and delayed

ICAEW has received many reports of statements not arriving. HMRC has confirmed that SA statements are being issued between 31 December 2017 and 8 January 2018 so clients may not receive them until the third week of January. HMRC has advised that paper SA statements will be issued before the due date for payment where returns were filed by 8 January 2018.

Payments on account not showing on statements

There has been a recurrence of the issue where payments on account (for 2017/18) do not appear on statements (paper and online). HMRC introduced a fix to correct this issue in December 2017 but it seems that this fix may have missed some cases.

It may be appropriate to advise clients who rely on HMRC statements to check that the payment on account due on 31 January 2018 is included in the sum they expect to pay.

It is extremely concerning that there are so many issues with HMRC’s SA software this year. ICAEW will pursue this poor service with HMRC. In the meantime we suggest that agents check calculations very carefully.

HMRC Takes The Protection of Customer Data Extremely Seriously and Has a Strong Security Culture!


As per The Register:
"Almost 1,500 software developers registered to use the UK taxman's sandbox or API platform have had their email addresses blabbed in a mass mailing.

The snafu happened on Friday afternoon, when an email about the HMRC Developer Hub was accidentally sent with users' addresses visible in the CC field.

The email, with the subject line "API Platform update", was sent by the software developer support team at 1604 GMT.

"Please note the HMRC Developer Hub will remain shuttered over the weekend to allow us to continue testing the service. The Developer Sandbox for testing remains available. The API Platform is working as expected," the seemingly innocent email stated.

However, about an hour later, someone must have pointed out the mistake, and the team issued a recall for the message, which meant the same group received another email with all 1,455 or so email addresses cc'd in.

At 1809, a third email – this time blind-copying in the list – was sent to apologise for the breach.
"HMRC's policy is always to protect customer data, and we take this responsibility very seriously," the email said.

"Unfortunately, in a recent email, a mistake was made and your email address may have been shared with other recipients.

"I wish to apologise for this error and for any distress this may have caused."

As the Reg reader who alerted us to the cock-up observed, this kind of error is easily made, especially when the time is ticking away to beer o'clock.

An HMRC spokesperson said: "HMRC takes the protection of customer data extremely seriously and has a strong security culture.

"We can confirm that this matter was immediately reported through our internal incident reporting process and will be fully reviewed. We have contacted the software developers affected to alert them and to apologise."
It's enough to make you weep!

HMRC Investigating Over Half of Britain's Largest Companies


HMRC investigations into large companies took 34 months on average in the year to the end of March 2017, up from 31 months in the previous financial year.

Pinsent Masons, the law firm that obtained the data, said the figures reflected HMRC’s increasingly aggressive approach to tackling corporate tax avoidance and a growing unwillingness to cut deals with large companies.

Ian Hyde, a partner at the firm, is quoted by the FT:
HMRC is digging its heels in and not backing down, even when there is a sensible settlement to be reached. Giving businesses certainty over the legal and tax environment is an important part of a smooth-running economy. Leaving these investigations open for three years at a time does not help that.
I was surprised at the HMRC response, wrt how many companies they investigate (spoiler alert over half the UK's largest businesses:
We subject large business to an exceptional level of scrutiny. At any one time, we will be actively investigating more than half of the UK’s 2,100 largest businesses."
Now, that either means UK businesses are inherently dishonest/incompetent; or, HMRC thinks that they are inherently dishonest/incompetent.

HMRC Is "Not Credible"


The public accounts committee has concluded, as we all have, that HMRC would struggle to deal with the pressure of Brexit and its own internal changes. Additionally, PAC are "far from confident" that HMRC can deal with the tax avoidance allegations made in the wake of the Paradise Paper leaks.

HMRC believes Brexit alone could add 15% to its workload, the report said.

HMRC is undertaking 15 major transformation projects, according to the MPs' report, involving the closure of offices around the country, relocating staff to 13 regional centres and and making tax returns digital.

The public accounts committee said that was now "not deliverable" as originally envisaged because of pressure on HMRC.

PAC quoted HMRC itself saying it was "not credible" to continue with its transformation programme as it is. It said HMRC had to "be clear about what it will do differently... and what the impact will be on customer service".
Committee chairwoman Meg Hillier is scathing:

"What was already a precarious high-wire act is now being battered by the winds of Brexit, with potentially catastrophic consequences.

Action arising from allegations in the so-called Paradise Papers could also significantly increase the authority's workload.

HMRC accepts something has to give and it now faces difficult decisions on how best to use its limited resources - decisions that must give full consideration to the needs of all taxpayers."
A spokesman for HMRC said they were "fully focused on making the UK's exit from the EU a success" and was on track to be able to deal with "a significant increase in customs declarations at the border" by January 2019.
